These Terms govern your use of the Olive Branch website, the Olive Branch portals and the text messages we send for sign-in. They are written to match our Privacy Policy (effective November 2, 2026) and use its defined terms.

1. Acceptance of These Terms

These Terms and Conditions ("Terms") are an agreement between you and Olive Branch Administration Inc. ("Olive Branch," "we," "us," or "our"). They apply to:

  • our website at www.obatpa.com (the "Website");
  • our online portals at portal.obatpa.com, including the member portal and the employer portal (together, the "Portal"); and
  • the text messages we send for account security (together with the Website and the Portal, the "Services").

By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Olive Branch is a third-party administrator for employer-sponsored and other benefit plans. We administer plans on behalf of employers and plan sponsors ("Clients"). We do not provide medical, legal or tax advice.

If these Terms conflict with your plan documents, the plan documents control on questions of eligibility, coverage and benefits. If you use the Services on behalf of a Client, your Client's written agreement with Olive Branch also applies.

2. Who May Use the Services and Your Account

Eligibility. Portal accounts are for plan members and covered dependents, Client administrators, and others we authorize. You must be at least 18 years old to create your own Portal account.

Invitations. You usually join the Portal through an invitation sent by your employer, your plan or Olive Branch. Invitation links are personal, can be used once and expire. Do not forward them.

Confirming your identity. Before we connect your coverage to an account, we may ask you to confirm details we hold, such as your date of birth and Social Security number. If the details do not match after several tries, the invitation may stop working, and you will need to ask for a new one.

Keeping your account secure. You agree to:

  • keep your password private and not share your account with anyone;
  • set up a second sign-in step, such as a one-time text code or a passkey, and keep your recovery codes somewhere safe;
  • sign out of shared devices; and
  • tell us right away at Admin@obatpa.com or 1-888-320-5111 if you think someone else has used your account.

You are responsible for activity under your account until you tell us it may be compromised.

Accurate information. Most of your personal and plan details come from your employer's or plan's enrollment records. To change them, contact your HR team or plan administrator. You agree not to give us false or misleading information.

Acting for someone else. You may view or act on another person's information only if the law and the plan allow it. Examples are a parent of a minor dependent, a person with a valid authorization, or a Client administrator acting within their role.

3. Text Message (SMS) Terms

What we send. We use text messages only for account security, such as one-time codes for two-step sign-in. We do not send marketing text messages.

How you opt in. You opt in when you enter your mobile number and tick the consent box while setting up text codes, either at your first sign-in or later in your account settings. The box reads: "I agree to receive automated text messages from Olive Branch Administration with one-time sign-in codes at this number. Message frequency depends on how often I sign in. Message and data rates may apply." We keep a record of your consent, including the date and time and the wording you agreed to.

Consent is optional. Consent to receive texts is not a condition of any purchase or service. You can choose another sign-in method, such as a passkey, instead.

Frequency and cost. Message frequency varies with how often you sign in or ask for a code. Message and data rates may apply under your mobile plan.

How to stop. Reply STOP to any of our text messages to opt out, or reply HELP for help. You can also turn off text codes in your account settings. While text codes are set up on your account, your consent stays in place; turning text codes off ends it. If text codes are your only sign-in method, set up another method first so you can still sign in.

Changing your number. To use a new mobile number, turn off text codes and set them up again with the new number. A new number needs new consent.

Help. Reply HELP, email Admin@obatpa.com or call 1-888-320-5111.

Carriers. Mobile carriers are not responsible for delayed or undelivered messages. Delivery depends on your carrier and device.

Your phone number. We do not sell or share mobile phone numbers or text messaging opt-in data with third parties or affiliates for their marketing purposes.

4. Plan Information, Claims and Enrollment

Your plan documents control. The Portal shows plan information such as benefit summaries, claims, balances, ID cards and cost estimates. It is provided for convenience. Your plan documents, including the Summary Plan Description and the Summary of Benefits and Coverage, decide eligibility, coverage and benefits.

No guarantee of coverage or payment. Information in the Portal is not a promise that a service is covered or that a claim will be paid. Claims are decided under the plan's terms and claims procedures. Cost estimates and automated answers (for example, from an "Ask" feature) are estimates only and may be incomplete or wrong.

Choosing plans. When your employer opens an enrollment period, you may choose, change or turn down coverage in the Portal. Your choice:

  • takes effect only if you are eligible under the plan's rules;
  • may be changed or withdrawn until the enrollment period closes; and
  • is set up by our staff after the period closes, effective on the date your plan sets.

If you do not make a choice, your plan's rules decide what happens, such as keeping your current coverage or ending it.

Claims and appeals. To appeal a claim decision, follow the appeal steps in your plan documents and in your Explanation of Benefits. Using the Portal does not change any deadline.

5. Privacy and Health Information

Privacy Policy. Our Privacy Policy explains how we collect, use, disclose and keep personal information, and the privacy rights you may have. It is part of these Terms.

Protected health information. For the plans we administer, we act as a "business associate" under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). Protected health information is handled under HIPAA, your plan's Notice of Privacy Practices and our agreements with Clients. It is not governed by the Privacy Policy. For questions about it, see your plan's Notice of Privacy Practices or contact your plan administrator.

Records of access. To protect your information, we keep records of who views and changes member information through the Services.

Sensitive information. Do not send health information, Social Security numbers or other sensitive information through general Website contact forms or email. Use the secure Portal, or call us at 1-888-320-5111.

6. Acceptable Use

You agree not to:

  • view, change or try to reach any account or record you are not authorized to access;
  • share your sign-in details, or use another person's;
  • give false information, or pretend to be someone else;
  • probe, scan or test the security of the Services, or get around any security or access control;
  • upload malicious code, or interfere with the Services or other users;
  • copy, scrape or collect data from the Services by automated means;
  • copy, change, reverse engineer or resell any part of the Services; or
  • use the Services for any unlawful purpose.

Client administrators. If you use the employer portal, you may use member information only to administer your plan, as the law and your plan documents allow. You are responsible for who in your organization you give access to.

We may monitor use of the Services to keep them secure and to enforce these Terms.

7. Electronic Communications and Signatures

Electronic delivery. By using the Portal, you agree that we may give you notices, statements, plan documents and other communications electronically. We may post them in the Portal or send them by email.

Electronic signatures. When you choose plans, name beneficiaries or turn down coverage in the Portal, you sign by ticking the agreement box and typing your full name. You agree that this electronic signature has the same effect as a handwritten one.

Your rights.

  • Paper copies: you may ask for a paper copy of any plan document or notice, free of charge, by contacting us.
  • Withdrawing consent: you may withdraw your consent to electronic delivery or electronic signatures by contacting us. Withdrawing does not undo anything you already signed, and some plan actions may then need to be completed on paper.
  • Keeping your details current: keep your email address up to date, through your HR team or by contacting us.
  • What you need: a current web browser, an internet connection and a device that can open PDF files.

8. Intellectual Property, Third-Party Links and Services

Our content. The Services, including their design, text, graphics and software, belong to Olive Branch or its licensors. They are protected by copyright, trademark and other laws. We give you a limited, personal, non-transferable right to use the Services for your own plan purposes or, for Client administrators, to administer your plan.

Trademarks. "Olive Branch," "Olive Branch Administration" and our logos are our trademarks. Do not use them without our written permission.

Third-party websites and services. The Services may link to websites run by others, such as Client, insurer, network or pharmacy portals. We are not responsible for those websites or their privacy practices. Their own terms apply when you use them.

9. Disclaimers, Limitation of Liability and Indemnity

Disclaimer. We work to keep the Services accurate, secure and available, but we cannot promise they will always be error-free or uninterrupted. To the fullest extent the law allows, the Services are provided "as is" and "as available," without warranties of any kind, express or implied.

Limitation of liability. To the fullest extent the law allows, Olive Branch is not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Services. Our total liability for any claim about the Services is limited to US $100.

Your rights under your plan and the law. Nothing in these Terms limits your benefits under your plan, your rights under the Employee Retirement Income Security Act (ERISA), or any right that cannot be waived by law.

Indemnity. To the extent the law allows, you agree to cover Olive Branch's losses and reasonable costs from claims caused by your misuse of the Services or your breach of these Terms.

10. Suspension and Termination

We may suspend or end your access to the Services if:

  • you break these Terms;
  • we need to protect the security of the Services or of other users; or
  • your eligibility or role ends, for example when your coverage ends, a Client's plan ends, or a Client removes your administrator access.

You may stop using the Services at any time. To close your Portal account, contact us.

Ending Portal access does not end your plan coverage, which your plan's rules decide. We keep records as described in the Privacy Policy and as the law and our Client agreements require.

11. Changes, Governing Law, Disputes and Contact

Changes to these Terms. We may update these Terms. We will post the new version with a revised "Last Updated" date. For material changes, we will give a prominent notice on the Website or by email before the change takes effect, where the law requires. If you keep using the Services after a change takes effect, you accept the updated Terms.

Governing law. These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. Federal law, including ERISA, applies where it governs.

Disputes. Any dispute about these Terms or the Services will be decided in the state or federal courts located in Clark County, Nevada. Questions about plan benefits or claims must first go through your plan's claims and appeals procedures.

General.

  • If any part of these Terms is found unenforceable, the rest stays in effect.
  • If we do not enforce a term, we have not waived it.
  • You may not transfer your rights under these Terms. We may transfer ours as part of a merger, acquisition or sale of assets.
  • These Terms, the Privacy Policy and any plan documents or Client agreements they mention are the whole agreement about the Services.

Accessibility. To get these Terms in another format, email Admin@obatpa.com or call 1-888-320-5111.
